Senate Approves Changes to Military Sexual Assault Policy

The Senate Armed Services Committee has approved new policies aimed to reduce the military’s growing problem with sexual assault. The new military sexual assault policy provides for additional safeguards when a sexual assault is reported. Under the new rules, commanders will automatically have their decisions to not prosecute a sexual assault reviewed by a higher-level commander. The new rules also require the implementation of a victims’ legal counsel program and more stringent reporting requirements as to how sexual assault cases are handled. The Senate Armed Services Committee rejected an even more far-reaching plan that would have implemented an independent legal counsel, separate from the chain of command, to handle sexual assault cases.

Veterans Disability Compensation for Victims of Military Sexual Assault

Military sexual assault is an increasing problem and can lead to not only short term physical and mental health problems but also to PTSD related to sexual assault that can last long after the attack. VA has recognized the reporting problems inherent in military sexual assault cases and has special rules in place for victims attempting to claim VA benefits for PTSD based on an in-service sexual assault.
