The First Step in Obtaining
Your Veterans' Disability Benefits
Filing a claim for veterans' disability benefits can seem to be a deceptively simple process. If you are a veteran and the claim is for yourself, you must complete an Application for Compensation (VA Form 21-526). If you are the surviving spouse or child of a veteran, you must complete VA Form 21-534 instead.
In either case, you will also need to attach a copy of DD Form 214 and any supporting military records, medical records and any other evidence that is relevant. If you do not have this form in your records, you can order a duplicate DD Form 214 from the National Personnel Records Center's online military personnel records system.
Once you have done that, mail the completed application and records (NOTE: retain copies for your own records as well) to the nearest VA Regional Office in your state.
As simple as this may sound, applying for benefits can still be confusing. The applications are long and complicated. It can be very hard to get clear information and guidance from the VA. Many other forms beyond those listed above may be required. If you have questions about filing an application — do not hesitate to call or contact the experienced lawyers for veterans at Bosley, McKown & Bratch.
Experienced Attorneys Handling
Veterans' Disability Claims Nationwide
Even though the VA is under a regulatory duty to assist veteran's seeking disability benefits, they are not always as helpful or forthcoming with clear information as they could be. In fact, the VA frequently fails to apply the law correctly in many cases.
